1. Acceptance of Terms
These Terms of Use ("Terms") constitute a legally binding agreement between you ("you," "your," or "user") and Travencio Routes LLC ("Travencio," "we," "us," or "our"), a limited liability company organized under the laws of the State of Texas and registered in Travis County, Texas. By accessing or using our website at travencio.com (the "Site") or any services offered through the Site (the "Services"), you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you must discontinue use of the Site and Services immediately.
2. Eligibility
You must be at least 18 years of age or the age of majority in your jurisdiction to use our Site and Services independently. Individuals between 13 and 18 years of age may use the Site under the supervision and with the consent of a parent or legal guardian who agrees to be bound by these Terms on the minor's behalf. By using the Site, you represent and warrant that you meet these eligibility requirements. Travencio reserves the right to refuse service to anyone for any lawful reason at our sole discretion.
3. Description of Services
Travencio provides travel booking coordination services including flight fare sourcing, tour bundle assembly, weekend route packages, hot departure deal listings, fare tracking, and traveler support. We act as an intermediary between you and third-party travel service providers including airlines, hotels, tour operators, and ground transport companies. Travencio does not own, operate, or control any of the aircraft, accommodations, vehicles, or activities associated with the travel services we arrange on your behalf. The actual delivery of travel services is subject to the terms, conditions, and policies of the respective third-party providers.
4. Use of the Website
You agree to use the Site and Services only for lawful purposes and in accordance with these Terms. You agree not to use the Site in any way that violates applicable federal, state, or local law or regulation, including the laws of the State of Texas. You shall not attempt to gain unauthorized access to any portion of the Site, other accounts, computer systems, or networks connected to the Site. You shall not use automated tools, bots, scrapers, or similar technology to access, collect, or extract data from the Site without our prior written consent. You shall not interfere with or disrupt the operation of the Site or the servers and networks used to make the Site available. You shall not impersonate any person or entity or misrepresent your affiliation with any person or entity.
5. Booking and Payment
When you submit a booking request through the Site or through direct communication with our team, you authorize Travencio to process the booking on your behalf with the applicable travel service providers. By confirming a booking, you agree to pay the total price as communicated in your booking confirmation, including the base fare or package rate, applicable taxes, service fees, and any add-ons you have selected. Payment is due at the time of booking unless alternative payment arrangements have been agreed upon in writing by a Travencio representative. All prices are quoted in United States Dollars (USD) unless otherwise specified. You are responsible for ensuring that all payment information you provide is accurate and that sufficient funds are available to cover the transaction amount.
6. Pricing and Availability
Prices displayed on the Site are starting fares or indicative rates and are subject to change based on availability, travel dates, carrier pricing adjustments, and currency fluctuations. A price is not guaranteed until your booking is confirmed and payment is processed. We make reasonable efforts to ensure that pricing information on the Site is accurate, but we do not warrant that all prices are free of errors. In the event of a pricing error, we will notify you before processing the booking and provide the corrected price for your approval. If you do not wish to proceed at the corrected price, you may cancel the booking without penalty.
7. Cancellation and Refund Policy
Cancellation policies vary depending on the type of service booked and the terms of the third-party provider involved. Many airlines allow free cancellation within twenty-four hours of booking. After that window, cancellation fees imposed by the airline or service provider may apply. Travencio charges a cancellation processing fee of $20 per booking in addition to any fees imposed by the provider. Refunds are processed back to the original payment method and may take ten to fifteen business days to appear in your account, depending on your financial institution. Non-refundable fares and packages are clearly identified at the time of booking. For tour bundles, deposits may be non-refundable if cancellation occurs within thirty days of the departure date.
8. Modification of Bookings
If you need to modify a confirmed booking, including changes to travel dates, passenger names, or itinerary details, contact our team as soon as possible at [email protected] or +1 (512) 793-2658. Modifications are subject to the policies of the airline or service provider and may incur change fees. Travencio charges a modification processing fee of $20 per change in addition to any fees imposed by the provider. We will communicate the total cost of the modification before proceeding and will not process changes without your explicit approval. Some fare classes and package types may not be eligible for modification.
9. Travel Documentation and Requirements
You are solely responsible for ensuring that you possess all required travel documentation, including a valid passport, visas, health certificates, and any other documents required for your destination. Travencio provides pre-departure guidance on documentation requirements as a courtesy, but we do not guarantee the accuracy or completeness of this information. Entry requirements are set by government authorities and can change without notice. Failure to present required documentation at check-in or immigration may result in denied boarding or entry, for which Travencio bears no responsibility or liability.
10. Intellectual Property
All content on the Site, including text, graphics, logos, images, photographs, icons, software, and design elements, is the property of Travencio Routes LLC or its content suppliers and is protected by United States and international copyright, trademark, and intellectual property laws. The "Travencio" name, logo, and all related marks are trademarks of Travencio Routes LLC. You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, or otherwise exploit any content from the Site without our prior written consent. Limited, personal, non-commercial use of the Site content is permitted solely for the purpose of viewing and using the Services as intended.
11. Limitation of Liability
To the maximum extent permitted by applicable law, including the laws of the State of Texas, Travencio Routes LLC, its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Site or Services. This includes, without limitation, damages for loss of profits, data, goodwill, or other intangible losses, even if Travencio has been advised of the possibility of such damages. Our total aggregate liability for any claims arising from these Terms or your use of the Services shall not exceed the total amount you paid to Travencio for the specific service giving rise to the claim during the twelve months preceding the date of the claim.
12. Disclaimer of Warranties
The Site and Services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. To the fullest extent permitted by law, Travencio disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or harmful components. We do not warrant or guarantee the quality, safety, or suitability of any travel services provided by third-party providers arranged through our Services. All travel services are subject to the terms and conditions of the respective providers.
13. Indemnification
You agree to indemnify, defend, and hold harmless Travencio Routes LLC, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site or Services, your violation of these Terms, your violation of any third-party rights, or any travel services you book through our platform. This indemnification obligation shall survive the termination of these Terms and your use of the Site.
14. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of laws principles. Any legal action, suit, or proceeding arising out of or related to these Terms or the Services shall be instituted exclusively in the state or federal courts located in Travis County, Texas, and you consent to the personal jurisdiction of such courts. You waive any objection to the exercise of jurisdiction over you by such courts and to venue in such courts. The prevailing party in any legal proceeding shall be entitled to recover reasonable attorneys' fees and costs.
15. Dispute Resolution
Before initiating any formal legal proceeding, you agree to first contact Travencio at [email protected] to attempt to resolve the dispute informally. We will make reasonable efforts to address your concerns within thirty days of receiving your written complaint. If the dispute cannot be resolved informally, either party may proceed with legal action as described in the Governing Law section above. Nothing in this section prevents either party from seeking injunctive or equitable relief in a court of competent jurisdiction to prevent irreparable harm.
16. Severability and Waiver
If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions. The failure of Travencio to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of Travencio.
17. Changes to These Terms
We reserve the right to modify these Terms at any time. Changes will be effective when posted on the Site with an updated "Last updated" date. Your continued use of the Site or Services after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically. For material changes, we may provide additional notice through email or a prominent announcement on the Site.
